By participating on the EquiVendor site as a Buyer or Seller you indicate that you have read and accepted the following Terms & Conditions of using this site.
EquiVendor does not sell or share your information with any third parties.
Credit/debit card payment processing is fully encrypted and processed through our merchant processor Stripe.
EquiVendor may contact users from time to time with special offers, promotions, and informational newsletters. Users may opt out of these emails at any time.

BUYERS agree to the following Terms & Conditions:
1) Buyer represents that he/she is of legal age to enter a binding contract.
2) Buyer acknowledges that placing a winning bid or Buy Now purchase is a legally binding contract of purchase. If Buyer places a winning bid on any auction Buyer also acknowledges that they are responsible for payment of the Buyer's Premium to EquiVendor for 3.5% of the winning bid.
3) Buyer acknowledges that the Seller of any auction listing has the right to set a reserve price for their listing and is not obligated to accept any bid that does not meet their reserve price.
4) Buyer acknowledges that all purchases on EquiVendor are at the sole risk of the Buyer, with no warranties, guarantees, or right of return unless expressly stated by the Seller. All items listed are on the terms of an as-is where-is sale unless otherwise specified by the Seller. In no instance shall EquiVendor be liable for any mispresentation by a Seller nor a party to any claims or disputes between Buyer and Seller. Both Buyer and Seller waive the right to any claims against EquiVendor for damages, losses, misrepresentions, or other liabilities with respect to transactions conducted on this website or occuring before or after purchase and sale.
5) In the case of horses the Buyer acknowledges bidding on the horse solely at their own risk. Buyer is responsible for any due diligence with respect to the soundness, fitness, suitability, and merchantability of the horse to their own satisfaction. Failure to perform such due diligence, including any prepurchase veterinary examination, is at the sole discretion of the Buyer and Buyer acknowledges this risk, with no right of actions against either Seller or EquiVendor.
6) Upon a successful bid the Buyer agrees to make full payment within 48 hours of auction end, failing which the item may be offered to the second highest bidder, with any shortfall in selling price the responsibility of the Buyer. All winning auctions are subject to a 3.5% Buyer's Premium and items or horses will not be released to the Buyer until both the item or horse and the Buyer's premium have been paid in full. All purchases made by Buyers in ONTARIO are also subject to 13% HST. **NOTE - ALL auction purchases over $500 MUST be paid via etransfer or bank wire transfer, not debit or credit card. Credit/debit card transactions are processed in USD.
7) Buyer is responsible for any shipping costs of all auctions won, unless specified otherwise by the Seller. Please read Seller terms carefully for horse sales with respect to board and care post sale as these will vary by Seller.
8) Buyer is responsible for Coggins test, health certificate, post sale veterinary care, and transportation costs for horses , unless otherwise specified by the Seller.
9) All sales on this site are FINAL with no right of return or refund for any reason whatsoever, unless specified by the Seller or agreed to between the parties of the purchase and sale.
10) These Terms & Conditions shall be governed by the applicable law in the County of West Grey, province of Ontario, Canada, and any legal disputes involving EquiVendor shall be brought forth and heard in this location.
11) Overdue accounts will accrue interest at the rate of 1 1/2% per month. NSF payments are charged a fee of $50.

SELLERS agree to the following Terms & Conditions:

2) Seller warrants that they do not have any liens or encumbrances on any item or horse offered for sale on this site.
3) Seller warrants that they are in possession of Registration Papers for any horse offered for sale as Registered and will furnish said papers and any required executed transfers to the Buyer upon receipt of payment in full for the horse.
4) In the case of an auction listing for goods, other than horses, Seller shall honestly represent the item's condition, brand and furnish current photos of the item. Seller shall state a shipping cost for the item, and their policy for accepting or not accepting returns. In the case of a returned item the Seller's commission paid to EquiVendor is not refundable.
5) In the case of an auction listing for a horse, Seller shall honestly represent the horse's current condition, size, age, level of training, soundness and vices, to the best of their ability, and be solely liable for any misrepresentations that may cause and entice a Buyer to purchase said horse and furnish current photos of the horse. Vices such as cribbing, weaving, stall walking must be disclosed in the auction listing.
6) Seller agrees to pay EquiVendor a commission rate of 7% on all items and horses sold on this site. EquiVendor shall collect funds from Buyers for all auctions won, shall deduct the Seller's 7% commission, and upon cleared funds shall pay the balance to the Seller via check, PayPal, bank wire, or etransfer within 7 days of Buyer's cleared payment.
7) Sellers acknowledge that the entry fee for a horse auction listing must be paid in full, in advance, before their listing is added to the desired auction. The base entry fee is $49, optional upgrades are also available.
8) For horse sales EquiVendor acts as intermediary for the collection of payment from the Buyer and release of funds to the Seller, for the security of both parties. Sellers funds, net of commission, will be paid within 7 days of receiving cleared funds from the Buyer. EquiVendor shall email a release to the Seller once cleared funds from the Buyer have been received. Both Buyer and Seller, or their authorized agents, must sign this release and email a copy back to EquiVendor in order to complete the transaction and release funds.
9) Sellers must state in their horse auction listing their post-sale terms for items such as board, Coggins, health certificate to facilitate transport, and any other extra terms of sale.
10) Once a horse is listed for auction on the EquiVendor site, the seller is agreeing to complete the auction without private sale during that time period. Should a private sale occur during that time the Seller is liable to EquiVendor for a commission of 10% of the sales price of the horse. Horses may only be withdrawn from the sale with a veterinary note. If a horse must be withdrawn the Seller shall have the option of substituting another horse at no extra charge.9) Sellers acknowledge that the entry fee for a horse auction listing must be paid in full, in advance, before their listing is added to the desired auction. The base entry fee is $49, optional upgrades are also available. All credit/debit card payments are processed in USD.
11) Seller has the right to set a starting bid and a reserve price for their horse and is not obligated to accept any bid less than the reserve price. Sellers bidding on their own horse shall be liable for the full Buyer premium and Seller commission should they end up the high bidder on their own auction.
12) It is strongly recommended, though optional, that the Seller has a basic clinical health and soundness examination done on the horse in writing by their own veterinarian, prior to listing the horse. EquiVendor will supply a veterinary examination form or you can use your own. This will help the Seller attain the maximum price for their horse. If you have xrays on file that can be shared with Buyers please state so in your auction listing. It is also recommended to have quality current photos and videos of the horse in your auction listing.
